Dispute a Will acted for the Executors and Beneficiaries of a Will that was made in hospital by the deceased some 10 days before her death.
The Will excluded the deceased's sister who benefited under an earlier Will. The sister alleged that the Will had not been properly executed and was made at a time when the deceased lacked mental capacity.
By interviewing the witnesses to the Will we were able to demonstrate that the Will had in all probability been properly executed and was therefore valid. Furthermore whilst the medical evidence was not clear it was certainly arguable that the deceased had the necessary capacity.
We were therefore able to negotiate a settlement of the case on terms upholding the validity of the last Will.
